NLP represents Defendants Asustek/Arvato/Digital River in the first case to be brought before the local Portuguese division of the Unified Patent Court (UPC).
We are also very pleased that the Court has held that, contrary to what was argued by the Applicant Ericsson, Rule 13.1(h) of the UPC Agreement should be interpreted as requiring disclosure before the court of any proceedings relating to the invoked patent which are ongoing in other courts/authorities and not only those which have been raised before the UPC or the European Patent Office (par. 10).
